Inp.polri.go.id - Jakarta. Coordinating Minister for Law, Human Rights, Immigration, and Correction Yusril Ihza Mahendra confirmed on Thursday (22/1/2026) that active Indonesian National Police (INP) officers may continue to hold specific civil service positions.
"The court explicitly ruled that these norms do not contradict the 1945 Constitution and remain legally binding," Minister Yusril said, responding to the Constitutional Court (MK) Decision No. 223/PUU-XXIII/2025, which rejected a judicial review challenging the Law on Civil Servants and the Indonesian National Police Law.
While the court rejected the petition, it recommended that future regulations regarding police placement in civilian roles be strictly governed by primary legislation, which is laws, rather than Government Regulations (PP).
Minister Yusril clarified that this suggestion acts as a "constitutional recommendation" rather than a legal prohibition. Consequently, active officers can still be appointed to roles linked to core police functions, providing the government with a firm legal basis to maintain current personnel distribution policies across various state institutions.
