inp.polri.go.id –  The National Police Code of Ethics Commission (KKEP) trial has rejected Ferdy Sambo’s appeal regarding the Disrespectful Dismissal (PTDH) as a police officer on Monday, September 19, 2022 yesterday.

The decision, which has permanent legal force, made Ferdy Sambo officially fired from the Police. Ferdy could no longer take any other legal remedies at the police because the decision was final and binding.

This decision received appreciation from Police Observer, Alfons Loemau,. Furthermore, Alfons asked the Police to immediately expedite Ferdy’s criminal case.

According to Alfons, it is not enough for the Police to bring this case to an ethics trial alone. This is because the actions taken by Ferdy Sambo are no longer violations but are categorized as crimes.

“This is a crime, it’s no longer just a violation. If it’s ethics, for example, there are minor and serious violations, such as a person who is absent for 30 days in a row, and that is a serious violation, and he will be fired. And those ‘serious violations’ is not a crime,” said Alfons on Thursday, September 22nd, 2022.

“If the case has eliminated evidence, complicates the investigation, then that is a crime,” he continued.

Alfons explained that the ethical trial decision only binds an organization, in contrast to the legal decision from the Court which is a higher legal product and is binding on all parties.

In addition, the actions of the Police to conduct an ethics trial against Ferdy Sambo should have been simpler in the case of a crime. Alfons thought that FS should have immediately been fired if involved in a crime case. The Special Inspectorate of the National Police should immediately take this case to the criminal stage as soon as the legal verdict is immediately dismissed, he said.

“It also sends a message that the Police is firm against their members who violates the law,” said Alfons.

So, said Alfons, in the event that a member of the National Police commits a criminal crime, there is no need for an ethics trial.

This could be an input for the leadership of the National Police. Alfons said, quick dismissal is good, However, in the context of criminal case, speeding up the criminal process is more important.
