Jakarta Remains National Capital Pending Presidential Decree: Constitutional Court

Inp.polri.go.id - Jakarta. The Constitutional Court has rejected a judicial review of Law Number 3 of 2022 on the Capital of Nusantara (UU IKN), confirming that Jakarta remains the capital of Indonesia. 

The court ruled that although the Capital of Nusantara has been legally designated as the new capital, the administrative transfer of power is contingent upon the issuance of a Presidential Decree .

"In reasonable reasoning, as long as the presidential decree regarding the relocation... has not been established, the national capital remains domiciled in Jakarta," said Constitutional Justice Adies Kadir during the ruling in Jakarta on Wednesday (13/5/2026), as cited by antaranews.com..

The petitioner, Zulkifli, had challenged the law over concerns of a "constitutional vacuum" following the enactment of the Jakarta Special Liaison Zone Law. However, the Court clarified that the Jakarta Law only takes full effect once the President formally signs the relocation decree.
