Constitutional Court Rejects Petition on Lifetime Driver's License Validity Period

Inp.polri.go.id - Jakarta. The Constitutional Court has rejected a judicial review of Law No. 22/2009 on Road Traffic and Transportation (LLAJ Law) regarding the validity period of driver's licenses. The judicial review case was filed by an advocate, identified as Arifin Purwanto, against Article 85 paragraph 2 of the LLAJ Law, which in its petition requested that the validity period of a driver's license be changed to life. The article states that a driver's license is valid for five years and can be renewed. "The court's verdict is to reject the applicant's petition in its entirety," said Constitutional Court Chairperson Anwar Usman at the Constitutional Court, Jakarta on  Thursday (14/9/2023). The Constitutional Court concluded that the petition was not well-founded according to the law, therefore, the petition was rejected in its entirety. In its verdict,  the panel of judges ruled that that the petitioner's argument requesting that the validity period of a driver's license be equated with an electronic ID card cannot be accepted because the two documents have different functions. The Constitutional Court considers ihe renewal period of a driver's license quite reasonable because the driver's license holders need to be evaluated and monitored for physical and mental health conditions as well as competence or skills in driving. "Within the limits of reasonable reasoning, the possibility of changes in the physical and spiritual health conditions of SIM holders can affect the competence or skills concerned in driving a motor vehicle," said Judge Enny  Nurbaningsing as quoted by antaranews.com. The Court is of the view that the renewal of a driver's license every five years is very functional to update the data of the license holder and is useful to support the interests of law enforcement officials in tracing the whereabouts of driver license's holders and their families in the event of an accident, traffic crime, or crime in general. There are different reasons, or concurring opinions, on the verdict. Constitutional Judge Daniel Yusmic P. Foekh encouraged lawmakers to consider an affirmative policy of lifetime driver's licenses for the elderly. "I am of the same opinion as the majority of the Judges that the petition is not well-founded according to law. However, in the future, the legislators need to consider an affirmative policy for the elderly to be given a lifetime driver's license," he said.
