Inp.polri.go.id - Jakarta.Chairman of the Honorary Council of the Constitutional Court (MKMK) Jimly Asshiddiqie has expressed concerns that nine MK judges may have potentially violated the code of ethics by allowing cases allegedly linked to the interests of their family members. Addressing the matter at the MK Building II in Jakarta on Wednesday (1/11/23), Jimly stated, "The nine MK judges in question are accused of violating (the code of ethics), because they allowed it (the decision of cases related to the judge's family). That's why we asked them, one by one. Each of them had their reasons." In light of the issues raised by the public with the MKMK, Jimly pointed out that the six judges who underwent questioning held varying opinions. "There will be those who ultimately prove to be correct, offering justifications, but there are also those who have issued warnings, albeit with limited effectiveness, and some who feel bad," he explained. Jimly underscored that if the judges are found to have violated the code of ethics, the MKMK might consider nullifying Case No. 90/PUU-XXI/2023 concerning changes in the eligibility criteria for a presidential and vice-presidential candidate. The MKMK recently questioned six judges, namely Anwar Usman, Arief Hidayat, Enny Nurbaningsih, Saldi Isra, Manahan Sitompul, and Suhartoyo, on October 31st and November 1st. Three other judges, namely Daniel Yusmic Pancastaki Foekh, Guntur Hamzah, and Wahiduddin, are scheduled for examination on Thursday. Concluding his statement, he affirmed that the MKMK will reach a decision on the ethics violation by Tuesday (7/11/23), following a thorough examination of the complainant, reviewing the report contents, and conducting interviews with all constitutional judges.
