Inp.polri.go.id - Jakarta. The Constitutional Court has ruled that deputy ministers are prohibited from holding concurrent positions as state officials, commissioners or directors of state-owned or private companies, or leaders of organizations funded by the state budget.
“Granting the petitioner’s request in part,” said Chief Justice Suhartoyo while reading the ruling at the Court’s plenary session on Thursday (28/8/2025), as quoted by antaranews.com.
The Court explicitly added the phrase “deputy minister” into Article 23 of Law No. 39/2008 on State Ministries, which previously only restricted ministers from double-posting. The article is now binding on both ministers and deputy ministers.
The petition was filed by lawyer Viktor Santoso Tandiasa and ride-hailing driver Didi Supandi, although the latter’s request was dismissed for lack of legal standing. Two justices, Daniel Yusmic P. Foekh and Arsul Sani, delivered dissenting opinions.
