DPR Passes New KUHAP Bill  Into Law

Inp.polri.go.id - Jakarta. The House of Representatives (DPR) on Tuesday (18/11/2025) unanimously approved the long-awaited revision of the Criminal Procedure Code (KUHAP), clearing the draft bill for enactment during the 18th Plenary Session of the 2025–2026 sitting period.

“Can we approve this to become law? Thank you,” DPR Speaker Puan Maharani said, receiving unified approval from lawmakers in the plenary hall, as quoted by antaranews.com.

The new KUHAP replaces the 44-year-old procedural framework enacted in 1981 and will take effect on 2 January 2026, alongside the revised Criminal Code (KUHP), according to Minister of Law Supratman Andi Agtas. 

He said the overhaul strengthens due-process guarantees, expands access to legal aid, and enhances protections for vulnerable groups.

Despite the government’s assurances, the reform has triggered public debate, with critics warning that several provisions, particularly expanded pretrial rules and electronic surveillance measures, may be inconsistently implemented or open to abuse. Officials have dismissed circulating misinformation, saying the bill was drafted with broad academic and civil-society input.

Key changes include mandatory examination cameras, clearer detention standards, and broader restorative-justice mechanisms.
