The Chairman of the Honour Council of the Constitutional Court (MKMK), Jimly Asshiddiqie, has outlined three sanction options for alleged violations of the Code of Ethics and Conduct of Constitutional Court Judges during the examination and resolution of Case No. 90/PUU-XXI/2023. These three options were reprimands, warnings and dismissal, all of which are regulated by the Ordinance of the Constitutional Court (PMK) No. 1 of 2023, he said. "In the PMK, sanctions are clearly defined as three types: reprimands, warnings and dismissals," Jimly said  in Jakarta on Tuesday evening (31/10/2023). Jimly explained that the dismissal option includes different forms: dishonourable dismissal, honourable dismissal, and dismissal not as a member of the Constitutional Court but as its chairman, antaranews.com reported. "As for warnings, not all of them are specifically articulated, but their variations can be extensive. There could be regular warnings, severe warnings or extremely severe warnings. So these variations are not specified in the PMK, but they can be very different," Jimly added. However, if the constitutional judges are not found guilty of the alleged violations, they will be rehabilitated. On Tuesday night, the MKMK questioned three of the reported nine judges, namely Anwar Usman, Arief Hidayat and Enny Nurbaningsih.  Other judges are scheduled for questioning on Wednesday and Thursday. In addition, MKMK will question the court officials involved in the case.  The MKMK started working for follow up public complaint about the Constitutional Court's recent decision, which altered the requirements to run for the presidential election.
