inp.polri.go.id - The National Police (Polri) took swift action in handling cases of blasphemy in the promotion of liquor by Holywings. With this swift action, Polri have named six suspects in the case of the Holywings promotion that stated the names of Muhammad and Maria could get free liquor.
Head of the Police Public Relations Division (Kadiv Humas), Inspector General Prof. Dr. Dedi Prasetyo, M.Hum., M.Sc., M.M., said that they have taken a quick action because this problem involved many people, and considered by many insulting the two major religions.
"This Holywings case offends and concerns the people. So it must be handled quickly. This is also law enforcement, to protect everyone, not only the suspect," said Dedi in the Deddy Corbuzier Podcast which uploaded Tuesday (28/6/2022).
Kadiv Humas Polri said that the interpretation of the names Muhammad and Maria was indeed broad. There are those who do not feel offended by the controversial promotion. Therefore, Polri acted professionally in handling the Holywings case.
The South Jakarta Metro Police investigators have asked for information from several expert witnesses such as linguists, criminal law experts, and religious experts.
"Such interpretations of the law can be interpreted broadly. But the South Jakarta Police investigatorshave gathered to the testimony of linguistic expert witnesses, then criminal law expert witnesses, and expert witnesses related to religious issues," said Kadiv Humas Polri.
Based on this, Polri immediately investigated whether this case was a violation of the law or not. "So when converting an unlawful act, the investigator must first fulfill the elements against the law. At a minimum, two pieces of evidence are required to determine the suspect in accordance with Article 184 of the Criminal Procedure Code," he explained.
Criminal law expert Azmi Syahputra said the police's move was the right one. "But the auxiliary perpetrators cannot be brought to justice before the main perpetrator is found guilty," said Azmi in Jakarta.
This means, if the perpetrators of these 6 suspects act based on orders from their leadership, then it is not impossible that there will be another suspects.
Azmi said that in cases related to religious elements, all parties must be careful not to offend anyone in their promotions, rules, and legal decency, he said.
