Traffic Corps Indonesian National Police issue the regulation the ticket with point system

inp.polri.go.id - Coordinator of Traffic Police Corps of Indonesian National Police issued Indonesian National Police Regulation (Perpol) No. 5/2021 about Issuing and Tagging of Driving License. By this means, traffic violators would be tagged with a point system, and if the person accumulated 18 points, their driving license could be revoked. Moreover, the driving license revocation as a punishment for the multiple violations can grow awareness in public on driving. The tag is given to the traffic violators or drivers experiencing traffic accident. This tagging later turned into points for every traffic violations. The numbers of license's tagging points are formulated based on its violations or accidents. In article 35 of Perpol No. 5/2021, the numbers of traffic violations points are five, three, and one point. "Points for traffic accident, as mentioned in article 33 paragraph 2 letter b, encompasses: (a) 12 points; (b) 10 points; or (c) 5 points", he said. Traffic violations category: 5 (five) points are given to the traffic violation types as follows: a. Driving without driving license (article 281, related to article 77 paragraph 1) b. Driving unreasonably and conducting things that cause concentration disturbance while driving (article 283, related to article 106 paragraph 1) c. Riding motorcycle that does not meet the technical and road-worthy requirements such as rearview mirror, horn, headlight, brake light (article 285 paragraph 2, related to article 106 paragraph 3, related to article 48 paragraph 2) d. Driving a four-wheeled or more motorised vehicle on roads that do not meet roadworthiness requirements (article 286 related to article 106 paragraph 3 related to article 48 paragraph 3) e. Everyone who drives a motorised vehicle on the road who violates rules of orders or prohibitions stated by traffic signs (article 287 paragraph 1) f. Violating rules of orders or prohibitions stated by signalling devices (article 287 paragraph 2) g. Violating rules of traffic movement (article 287 paragraph 3) h. Violating regulations on usage or primary rights of motorised vehicles that uses warning devices through sound or light (article 287 paragraph 5 related to article 106 paragraph 4 letter g or article 115 letter a) i. Trespassing rail crossing (article 296 related to article 114 letter a) j. Illegally racing on the street (article 297 related to article 115 letter b) 3 (three) points given for the traffic violation types as follows: a. Modifying vehicles that may disturb traffic safety (article 179 of Traffic and Road Transport Law) b. Not installing vehicle plate number (article 280) c. Driving without prioritising pedestrian or cyclist safety (article 284) d. Four-wheeled or more vehicles that have no technical requirements (article 285 paragraph 2) e. Driving four-wheeled or more motorised vehicles on the road that do not meet roadworthiness requirements (article 286) f. Violation towards article 287 paragraph 1, 2, and 5 g. Motorised vehicles running without motorised vehicle registration certificate (STNK) or motorised vehicle trial certificate (STCKB) stated in article 288 paragraph 1. h. Public transport vehicle, bus, freight car, and trailer without periodic vehicle test and passing statement of periodic vehicle test (article 288 paragraph 3) i. Violation of article 298 of Traffic and Road Transport Law j. Violation of article 305 of Traffic and Road Transport Law k. Violation of article 307 of Traffic and Road Transport Law l. Violation of 308 of Law No. 22 of 2009 about Traffic and Road Transport Law 1 (one) point given for traffic violations as follows: Traffic violations stated in article 275 paragraph 1, article 276, article 278, article 282, article 285 paragraph 1, article 287 paragraph 3, 4, and 6, article 288 paragraph 2, article 289, article 290, article 291, article 292, article 293, article 294, article 295, article 300, article 301, article 302, article 303, article 304, and article 306 of Law No. 22 of 2009 about Traffic and Road Transport Law. Points for traffic accidents encompass 12 points, 10 points, and 5 points. 12 (twelve) points given to traffic accidents stated in article 310 paragraph 3 and 4, and article 311 paragraph 4 and 5 of Law No. 22 of 2009 about Traffic and Road Transport Law. 10 (ten) points, stated in article 1 letter b, are given to traffic accidents as stated in article 275 paragraph 2, article 311 paragraph 2 and 3, and article 321 of Law No. 22 of 2009 about Traffic and Road Transport Law. 5 (five) points, stated in article 1 letter c, are given to traffic accidents as stated in article 310 paragraph 1 and 2, and article 311 paragraph 1 of Law No. 22 of 2009 about Traffic and Road Transport Law. Multiple traffic violation attempts are lead to point accumulation. If the violation has accumulated to 12 points, the violator would be given the first penalty. If it has reached 18 points, they would be given a second penalty. "Driving license owners that accumulate 12 points as stated in article 37 paragraph 2 letter a would be subjected to license's temporary hold or revocation before the court's decision", as stated in article 28 of Perpol No. 5/2021. The driving license owners who got the first penalty are subjected to education and driving training to get the driving license back, which has been temporarily held or revoked. For the driving license owner who has accumulated 18 points, the license would be revoked based on a court decision with permanent legal force.
