Inp.polri.go.id – Jakarta. General Election Supervisory Body (Bawaslu) faces many problems regarding issues of neutrality violations by state civil servants (ASN).
“This problem with ASN is really out of this this world. During Regional Elections on 2020, there are 1,536 alleged violations with 53 cases being stopped and 1,398 cases recommended to be processed,” says Coordinator of the Violation, Data and Information Handling Division of Bawaslu, Puadi on Tuesday (10/10/2023).
He says there are differences in handling ASN neutrality violations in Law Number 17 of 2017 concerning Elections, Law Number 10 of 2016 concerning Regional Elections, and Law Number 5 of 2014 concerning ASN.
He says that in ASN Laws, neutrality violations would only be punished with administrative sanctions. Meanwhile, in the Election Law and Regional Election Law there are two types of sanctions, which administrative and criminal.
Moreover, there are many ASN neutrality violations process recommendations that has been neglected.
“There are also recommendations from KASN (State Civil Service Commission) which was not followed up by the PPK (Personnel Development Officer). This is an important note that should be addressed,” he said.
In facing this issue, Bawaslu would intensify their dissemination of regulations related to guidelines for the guidance and supervision of ASN neutrality in elections. According to KASN data on 2022, there are 2,073 ASN reported have violated their neutrality.
Around 1,605 ASN, or 77.5% of ASN that has been reported, confirmed to be guilty and recommended by KASN to be sanctioned.
Meanwhile, 1,420 ASN, or 88.5% of ASN that has proven guilty has their case been processed and received moral and disciplinary sanctions PPK.
