Bawaslu Urges Indonesian Military-INP Neutrality in the 2024 elections

Inp.polri.go.id - Jakarta - The Election Supervisory Agency (Bawaslu) has issued a reminder to the Indonesian Military and the Indonesian National Police (INP) over  their crucial role in maintaining neutrality during the upcoming 2024 elections. "Bawaslu possesses the authority to oversee the neutrality of ASN, TNI, and INP, as stipulated in Law 93 Number 7 of 2017, while urging these agencies to adhere to the regulations," said Bawaslu Chairman Rahmat Bagja as reported by Antara on Wednesday (13/9/23). He  disclosed that Election Law Number 7 of 2017 outlines a total of 77 norms for election offenses, with a specific focus on village heads, State Civil Servants (ASN), the Indonesian Military, and INP, encompassing 16 norms. Any violations by the Indonesian Military and the INP result in severe consequences across three key aspects.  First, from an administrative standpoint, failure to withdraw as a candidate for election will result in disqualification due to failure to meet the requirements. Secondly, from a criminal perspective, any TNI members discovered to be affiliated with a campaign team or participating in the voting process may face criminal penalties under Article 494 of the Election Law. "The third implication pertains to the code of ethics and disciplinary violations. For broader violations beyond the scope of Election Law regulations, the resolution of these disciplinary matters will be handled internally by TNI authorities," he elaborated. He emphasized that the77 norms in the Election Law, ranging from Article 488 to Article 553, highlighted the law's central role as the primary legal structure for dealing with matters related to elections. The Bawaslu chairman also noted that all cases of election offenses should be reported to Bawaslu and, afterward, directed to the Integrated Law Enforcement Center (Gakkumdu).
