Inp.polri.go.id - Jakarta. The Constitutional Court (MK) has instructed the government and the House of Representatives (DPR) to establish an independent agency within two years to supervise the implementation of the merit system and monitor civil servants’ conduct.
“The independent body must oversee the application of principles, core values, code of ethics, and code of conduct for civil servants,” said Constitutional Judge M. Guntur Hamzah during the plenary session on Thursday (16/10/2025). “This ensures meritocracy is applied consistently, free from political interference, and protects the career paths of civil servants.”
The ruling addressed challenges stemming from the dissolution of the State Civil Apparatus Commission (KASN) under Law No. 20/2023, whose oversight functions were transferred to the National Civil Service Agency (BKN) and Ministry of Administrative and Bureaucratic Reform (PANRB).
THe Court highlighted the need to separate policy-making, implementation, and supervision to prevent conflicts of interest and maintain a professional, accountable bureaucracy, as reported by antaranews.com.
It emphasized that forming the independent oversight body is the legislative authority’s responsibility and must be completed within two years.
