"The agreement in question can actually provide a legal basis for protecting the personal data of Indonesian citizens when using digital services provided by US-based companies, such as search engines, social media, cloud services, and e-commerce," explained Minister of Communication and Digital Affairs Meutya Hafid on Thursday (7/24/2025).

US President Donald Trump announced key points in the import tariff agreement with the Indonesian government, one of which addresses the transfer of personal data.

An official statement issued by the White House stated that this is regulated under the point regarding the elimination of barriers to digital trade. It stated that the United States and Indonesia will finalize commitments related to digital trade, services, and investment.

One of Indonesia's commitments is to provide certainty regarding the ability to transfer personal data from its territory to the United States.

"Indonesia will also provide certainty regarding the ability to transfer personal data from its territory to the United States by recognizing that the United States is a country or jurisdiction that provides adequate data protection under Indonesian law," the statement read.

The Ministry of Communication and Digital Affairs explained that negotiations and technical discussions between the Indonesian and United States governments are ongoing, and the agreement communicated by the White House is still being finalized.
