Banten Regional Police's Head of Public Relations, Pol. Grand Commissioner Attendant Shinto Bina Gunawan Silitonga said the basis for the investigation of Arrest Operation unscrupulous National Land Agency employees started from public information, which was then stated in the Information Report (LI) and followed up with Police Report (L.P.) Number 443, dated November 13, 2021. "Since November 13, 2021, the Directorate of Criminal Investigation of the Banten Regional Police investigated criminal acts of corruption resulting from the O.T.T., meaning that investigators found legal facts about corruption," said the Head of Public Relations of the Banten Police during a press conference at the PR Hall of the Banten Regional Police on Monday (11/15/21).
To this day, the Banten Regional Police have named two suspects for extortion, namely RY (57), Civil Servant of the Land Management Section at the Lebak's National Land Agency PR Office (41), Non-PNS Government Employees at the Administration Section of the Lebak's National Land Agency Office.
Deputy of Special Crime Banten Police, Pol Grand Commissioner Attendant Hendy Febrianto Kurniawan, explained that since December 2020, a woman with the initials L.L. has applied for a Certificate of Ownership (S.H.M.) for the land she bought covering an area of 30 ha in Intan Jaya Village, Cimarga District, Lebak Regency. L.L. authorized the initial management to D.D., where at that time, L.L. had provided funds of Rp. 117,000,000, but until D.D. died, there was no progress in the management of the S.H.M. After D.D. passed away, L.L. authorized the management of the S.H.M. to M.S., who worked as a village head in Lebak. "L.L.'s sister then asked M.S. to take care of the S.H.M. after D.D. died, the hundreds of millions of funds that L.L. gave are not known where D.D. used it," quoted Deputy of Director Special Crime Banten Police.
In October 2021, there was a meeting between M.S. and P.R. and R.Y., B.P.N. Lebak staff who asked for additional fees for the management of the S.H.M. "Initially it was worth Rp. 8,000 per m2, but it was finally agreed to," explained the Banten Regional Police's Deputy Chief of Directorate of Criminal Investigation. After the meeting, L.L. then submitted an initial application for the management of S.H.M. land covering an area of 17,330 m2 by preparing funds of IDR 36,000,000 to meet the request for additional fees for managing the S.H.M. Apart from that, on October 19, 2021, L.L. had paid a Non-tax revenue fee of IDR 1,833,000 to the Lebak's National Land Agency Office. However, L.L. did not get the certainty of the measurement results and the completion time of the Ownership Certificate management, so L.L. finally wanted to prepare the money as requested by the Lebak National Land Agency employees. "After the money was handed over, investigators made arrests of the perpetrators," said the Banten Regional Police's Deputy Chief of Criminal Investigation Directorate.
The perpetrators' modus operandi is to ask for additional fees for Ownership Certificate management services by providing a specific target amount of money per m2 outside of Non-tax revenue. "Following P.P. No. 128 of 2015 concerning Types and Tariffs for Non-tax revenue Types Applicable to the Ministry of Agrarian Affairs and Spatial Planning/National Land Agency, it is determined that the value of Non-tax revenue is only IDR 100 per m2 and L.L. has paid that, "said Shinto Silitonga. In addition, the procedure for managing the Ownership Certificate is also not carried out following the time lining stipulated in the Regulation of the Head of National Land Agency No. 1 of 2010 concerning Service Standards and Land Regulations. "After the applicant pays Non-tax revenue at the counter, according to the rules, within 18 days the field map must be issued, but in fact, the applicant does not also get a field map according to the measurement results," said the Banten Regional Police's Deputy Chief of Directorate of Criminal Investigation and Investigation.
Banten Regional police's Deputy Chief of Directorate of Criminal Investigation and Investigation, Pol. Grand Commissioner Attendant Hendy Febrianto Kurniawan said that the perpetrators' motives were to intentionally abuse their authority to gain economic benefits for themselves and others. A total of IDR 36,000,000, one CCTV DVR unit and two mobile phones.
