inp.polri.go.id - Bogor. Member of Commission VI of the Indonesian House of Representatives (DPR) Asep Wahyuwijaya stated that State-owned Enterprises (BUMN) administrators and management are not immune from the law.
Asep explained that BUMN directors, commissioners, and supervisors can still be subject to corruption charges if they commit irregularities in the state funds they manage.
For example, state funds given to PLN and Pertamina are subsidies for the people, but if they commit irregularities in the state funds, they can be subject to corruption charges.
Furthermore, Asep stated that BUMN administrators and management who do not even manage state funds directly can still be subject to criminal charges if they violate the principles of the business judgment rule.
This principle, he said, demands that BUMN directors and commissioners in making decisions and policies with good faith for the progress of the company, be careful, and not be involved in conflicts of interest.
If the BUMN suffers losses due to violating these principles, he continued, the directors, commissioners, and supervisors of the BUMN could also be subject to legal action.
"The prosecutor's office and the police could follow up on their findings, and the Ministry of BUMN, the DPR, and anyone else could report it to law enforcement," Asep said.
