Foreign State-Owned Enterprises Executives Not Immune from Indonesian Law: AGO

Inp.polri.go.id - Jakarta. The Indonesian Attorney General’s Office (AGO) confirmed that foreign nationals serving as executives in state-owned enterprises (BUMN) remain subject to Indonesian law if implicated in criminal cases, including corruption.

“We adhere to positive law. As long as the act occurs within Indonesia’s jurisdiction, anyone can be prosecuted, especially if it causes state losses,” said AGO spokesperson Anang Supriatna on Friday (17/10/2025), as quoted by antaranews.com.

He cited a precedent involving Hungarian national Gabor Kuti, the CEO of Navayo International AG, who was named as a suspect in a 2016 satellite procurement corruption case handled by the Military Crimes Division (Jampidmil). He stressed that law enforcement would be carried out professionally and cautiously, particularly when state finances are at stake.

His remarks came after President Prabowo Subianto recently allowed foreigners to lead BUMN. State carrier Garuda Indonesia has since appointed two expatriates, Balagopal Kunduvara and Neil Raymond Mills, to key board positions following an extraordinary shareholders’ meeting on 15 October 2025.
