Komnas Perempuan Urges Police to Address Child Custody Deprivation Cases

Inp.polri.go.id - Jakarta.  The National Commission on Violence Against Women (Komnas Perempuan) has called on police to promptly address cases of child custody deprivation, referencing a recent Constitutional Court ruling on 26 September 2024.

“Court decisions clarify Article 330, Paragraph (1) of the Penal Code, which criminalizes parents unlawfully taking custody of a child as determined by a court,” said Komnas Perempuan commissioners Andy Yentriyani, Alimatul Qibtiyah, and Theresia Iswarini in a statement on Saturday (28/9/2024). 

The Commission stressed the importance of swift action from the Indonesian National Police (INP) newly formed Directorate for Women’s and Children’s Crimes and Human Trafficking (DitPPA-PPO). They also noted that in mixed marriages, international cooperation is vital to prevent child relocation outside Indonesia.

In its ruling, the Court emphasized that police should not hesitate in accepting reports related to this matter. Constitutional Judge Arief Hidayat said that there should be no doubt for law enforcement, particularly police investigators, in receiving reports regarding the application of Article 330, Paragraph (1).

 

The ruling enhances the state’s responsibility for human rights and contributes to ensuring children's rights for proper development, as mandated by Indonesia’s 1945 Constitution.
