inp.polri.go.id – The Maluku Regional Police (Polda Maluku) held a public dialogue with the theme of Restorative Justice. The dialogue took place at the RRI Ambon office, Thursday (2/6/2022).
The event presented a number of presenters. Among them, the Dean of the Faculty of Law UKIM Ambon, Dr. Jhon Dirk Articlebessy SH, M. Hum., Head of the Gasira Maluku Foundation, Dr. Liez Marantika, and Director of General Crimes (Dirkrimum) of Polda Maluku, Commissioner Andri Iskandar, S.I.K.
Dr. Jhon said that restorative justice is the balance between the interests of the state and the victims, because crimes can also occur because of the victims themselves.
According to him, restorative justice had existed for a long time, without many of us realizing it. Restorative justice was a legal model in seeking justice by paying attention to existing legal signs, which at that time is the customary law.
"We must understand that restorative justice does not only involve victims and suspects but also involves related people or legal institutions. This is to prevent people from thinking that restorative justice is a normal thing which if there is a problem there is no need to report it to the police, this is an understanding that must be understood," he explained.
Meanwhile, Liez Marantika revealed that restorative justice is a good opportunity to fulfill the rights of victims. Currently in Maluku, there are many cases of domestic violence that often occur in families whose economy is weak.
Marantika continued that she is committed to providing assistance because they are also entitled to legal assistance.
"I want to say that currently, in our society, the crime rate is very high, so something is wrong," she said.
Marantika hopes that the state will pay attention in socializing the restorative justice to the public, starting from the lowest level to all the way up. This is so that they can manage every problem that occurs with the potential that exists.
"Because in every village there must be community leaders, religious leaders, and traditional leaders who have an important role in enforcing restorative justice for the problems that occur," he hoped.
Dirkrimum Polda Maluku, Andri Iskandar, admitted that restorative justice cannot be applied to all criminal cases. One of them is the case of terrorism, corruption, and several other cases. There are some special requirements in the application of restorative justice that must be met, one of whic is that both parties agree with it.
Andri continued that Polda Maluku always proactive in handling any criminal cases. For example, if the victim is unable to attend for questioning because of the cost or distance and transportation or health conditions, the investigator will go to the victim or witness.
"We, Polda Maluku, really hope that our people can jointly maintain order and security. If there is a criminal problem, our Ditkrimum Polda Maluku is ready to serve, especially in restorative justice," he explained.
