Constitutional Court Rejects the Petition Related to the Police Members in ASN Positions

The Constitutional Court (MK) has officially ruled on case No. 223/PUU-XXIII/2025 concerning the petition for judicial review of Article 19 paragraphs (2), (3), and (4) of Law No. 20 of 2023 concerning the State Civil Apparatus (ASN) and the Elucidation to Article 28 paragraph (3) of Law No. 2 of 2002 concerning the Indonesian National Police.

The hearing, which included the reading of the verdict, was held on Monday (1/19/2026) at the Constitutional Court Building in Jakarta, presided over by the Chief Justice of the Constitutional Court and eight other constitutional justices.

The petition for judicial review was filed by two applicants: Zico Leonard Djagardo Simanjuntak, as the First Petitioner, and Zidane Azharian Kemalpasha, as the Second Petitioner. 

The applicants primarily questioned the regulation regarding the placement of police members in ASN positions outside the police institution without the obligation to resign or retire.

During the hearing, the Indonesian National Police (INP) were represented by a legal team consisting of BJP Veris Septiansyah, KBP Dandy Ario Yustiawan, IPDA Brandon Ridle Julio Tumanduk, and IPDA Jerico Rizaldi Silitonga.

After hearing testimony from the parties and considering the existing legal aspects, the Constitutional Court ultimately rejected the petition filed by the petitioners.

In its ruling, the Constitutional Court declared Petitioner II's petition inadmissible (Niet Ontvankelijke Verklaard), while Petitioner I's petition was rejected in its entirety.

In response to the ruling, Brigadier General Trunoyudo Wisnu Andiko, Head of Public Information for INP Public Relations Division, stated that INP fully respects the Constitutional Court's decision as the highest judicial institution in judicial review.

"We fully respect the Constitutional Court's decision," said Brigadier General Trunoyudo.

According to him, the Constitutional Court's ruling also provides legal certainty regarding the mechanism for placing Polri members in certain positions outside the police institution.
