inp.polri.go.id - Jakarta. Professor of the Faculty of Law, Prof. I Gede Panca Astawa, responded to the issuance of Constitutional Court (MK) Decision Number 223/PUU-XXIII/2025, which was issued on Monday (January 19, 2026). 

The decision concerns the judicial review of Law Number 20 of 2023 concerning the State Civil Apparatus (ASN) and Law Number 2 of 2002 concerning the Indonesian National Police (INP) against the 1945 Constitution of the Republic of Indonesia.

In his statement, Prof. Panca Astawa explained that the judicial review petition was filed by two applicants: an advocate as the first applicant and a student of the Faculty of Law as the second applicant.

"In Decision Number 223/PUU-XXIII/2025, the Constitutional Court rejected Petitioner I's petition in its entirety because the principal points of the petition were deemed legally groundless. As for Petitioner II, the Constitutional Court declared his petition inadmissible due to its lack of legal standing," said Prof. Panca Astawa. Panca Astawa.

He explained that there were several key legal considerations underlying the Constitutional Court's decision. One of these was the relationship between the Civil Servant Law and INP Law.

"The two laws being reviewed, specifically Article 19 paragraph (3) of the Civil Servant Law and Article 28 paragraph (3) of the National Police Law and its explanation, are intertwined.

This means that members of INP can hold certain civil servant positions in central agencies based on the merit system stipulated in the Civil Servant Law and in line with the main duties of INP.
