Indonesia Took Civil Law Action over the Death of Adelina Lisao

inp.polri.go.id – Jakarta. The Indonesian government will take civil action over the death of Indonesian Migrant Workers (TKI) Adelina Lisao in Malaysia. The case of the death of the migrant worker from East Nusa Tenggara has been completed in the criminal court where the employer was found not guilty on charges of murder. Even at the Malaysian Appeals Court level, the judge considered Adelina's employer, Ambika MA Shan, to be innocent. The Malaysian Supreme Court, last Thursday (23/06/22), also rejected the public prosecutor's appeal to overturn the High Court's decision to ratify the release of Adelina's employer, Ambika MA Shan. The Director of Protection for Indonesian Citizens and BHI at the Ministry of Foreign Affairs, Judha Nughara, said the government would continue to seek justice for the late Adelina Sau, through civil law for claims for compensation. "This process requires the approval of the heirs because the families of the victims, are also the victims. The Indonesian Embassy will provide assistance and support for the provision of lawyers," Judha said in a written statement. Judah said the Malaysian Federal Court's decision to reject the appeal was certainly very disappointing and hurt the Indonesian people's sense of justice. "According to Malaysian law, the party carrying out the prosecution is the Public Prosecutor. The Indonesian Embassy in Kuala Lumpur and the Indonesian Consulate General in Penang have appointed a retainer lawyer to monitor the trial process. Observations show that the Public Prosecutor is not careful and is not serious in handling this case," he said. Judha added that various efforts had been made from the beginning by the Indonesian government to provide justice for Adelina and her family. In Indonesia, thanks to cooperation with the Police and the NTT Regional Government, three recruiters of the late Adelina have been arrested. In addition, the Ministry of Foreign Affairs through the Indonesian Consulate General in Penang and the Indonesian Embassy in Kuala Lumpur have also succeeded in obtaining the financial rights of the late Adelina in the form of a salary while working and other rights. Previously, Adelina was found dead on the terrace of her employer's house in February 2018. She is said to have suffered complications from multiple organ failure because she was allegedly tortured where she worked at her employer, Ambika's house, in Bukit Mertajam, Malaysia. Adelina's neighbors reported that she slept in a dog kennel with burns and bruises all over her body before she died.
