Inp.polri.go.id - Depok. The Coordinating Minister for Political, Legal and Security Affairs, Mahfud Md, said on Wednesday (20/12/2023) that individuals involved in human trafficking are not eligible for restorative justice as such crimes are considered serious.
He explained that restorative justice is only meant for minor offences or petty crimes with minimal impact and can be resolved amicably between the offender and the victim, antaranews.com reported.
"There is no reconciliation for human trafficking; it is a serious crime and the perpetrators must be imprisoned," he said.
According to Minister Mahfud, restorative justice is a cultural legacy of Indonesia's legal community, where issues are resolved through deliberation involving traditional leaders.
When applied to modern times, restorative justice can be considered for offenses such as defamation or traffic offenses because the common punishment for such offenses is usually a few months' imprisonment as they do not pose a threat to life.
"But for serious crimes such as money laundering, human trafficking, corruption, premeditated murder, smuggling, there is no restorative justice; it cannot be resolved amicably, it has to be dealt with in court," Minister Mahfud said.
He expected that victims of human trafficking would strongly resist any attempt by the perpetrators to settle the case peacefully, even if they were promised a substantial financial reward.
