Inp.polri.go.id - Jakarta. The Constitutional Court (MK) has ordered the House of Representatives (DPR) and government to draft a new labor law, separate from the 2023 Omnibus Law on Job Creation, with a deadline of two years.
The Court ruled that labor unions must be actively involved in the legislative process, as reported by antaranews.com.
Constitutional Justice Enny Nurbaningsih stressed the need to address potential conflicts within existing labor laws, directing that the new legislation incorporate elements from the 2003 Labor Law, the Job Creation Law, and relevant Court rulings.
The Constitutional Court highlighted that overlapping regulations in the current framework threaten legal certainty and fairness for both employees and employers. The Court warned that without a timely resolution, Indonesia’s labor regulations risk prolonged legal uncertainty and injustice.
The ruling was partially granted a judicial review motion filed by labor groups, including the Labor Party and several unions, challenging provisions on foreign workers, outsourcing, minimum wages, and severance pay.
The Court granted constitutional approval to 21 elements of their petition.
